National Programme for Adoption of the Acquis Communautaire


In 2007 the Government of the Republic of Macedonia adopted the National Programme for Adoption of the Acquis Communautaire (NPAA).

The revised and upgraded NPAA 2008 was approved by the Government on 4th of March 2008. Government also approved a separate plan - Measures and Actions for implementation of the benchmarks (the key priorities of the Accession Partnership) and it was endorsed by the Council for Euro-integration of the Assembly of the Republic of Macedonia.

The revision of the NPAA was focused on further analysis of the acquis communautaire and relations to the national legislation, using the experience of the countries that underwent the screening process.

Beside the existing frame laws, Government of Republic of Macedonia should adopt all additional bylaws in accordance with determined NPAA timeframe.

According to the NPAA draft matrix, Law on Genetically Modified Organisms should be adopted in the period of 30.08.207 to 31.03.2008. The Law was adopted in March 2008.

In the Law on Genetically Modified Organisms (Official gazette nb. 35/2008) the following EU Directives are transposed: 2001/18/ EC of the European Parliament and of the Council of 12 March 2001 on deliberate release of genetically modified organisms into the environment, supplemented by Regulations (EC) 1829/2003 and 1830/2003, as well as Decisions 2002/623/EC and 2002/811/EC and Council Directive 90/219/EC of 23 April 1990 on the contained use of genetically modified micro-organisms amended by Directive 98/81/EEC, amended by Regulation (EC) 1882/2003 and Decisions 2001/204/EC and 2005/174/ EC.

In the upcoming period, on the basis of this law, the bylaws for regulation of deliberate release of GMOs into environment should be prepared and adopted. The final transposing is planed till the end of 2010.

According to the list of legal acts the following bylaws should be adopted during the period 2008-2014:

- Decree on the establishment of a Commission for GMO management, deadline tî 30.09.2008
- Decision on the establishment of a Scientific committee for GMO, deadline tî 30.09.2008
- Rulebook on the form and contents of the notification on limited GMO use and on information to be necessarily provided by the user when submitting the notification to the MEPP containing information required in cases such notifications relate to areas within which GMOs are to be used for the first time, provided separately for each class of limited GMO use, deadline to 30.09.2008
- Rulebook on the more specific contents of contingency plans, deadline: 31.12.2008
- Rulebook on the contents of information accompanying the notification for intentional disposal of GMO to the environment, deadline to 31.12.2008
- Decree on determining GMOs whose intentional disposal in the environment and/or release as GMO products in the market is prohibited, deadline to 31.12.2008
- Decree on evaluation general principles, contents, scope and methodology appropriate to the character of GMO introduced and to the environment, according to which assessment is done of environmental risk, deadline to 31.12.2008
- Decree on determining areas where disposal of genetically modified reproductive material is not permitted to the environment, deadline to 31.12.2008

This list of legal acts is rewised and the draft matrix was prepared for every year. According to the draft matrix till the end of 2008 two bylaws should be adopted:

- Decree on the establishment of a Commission for GMO management, deadline tî 30.09.2008
- Decision on the establishment of a Scientific committee for GMO, deadline tî 30.09.2008

According to the Ministry of Environment and Physical Planning of Republic of Macedonia, these two bylaws are already prepared and submitted to the Government of Republic of Macedonia. Their adoption and enforcement is expected very soon.
